Robert Petker Inc. is a registered California Seller of Travel, permit no 2060469-40. Registration as a seller of travel does not constitute approval by the State of California.
Responsibility
Robert Petker Inc. is acting as a tour operator. The suppliers
providing transportation, hotel accommodations and meals are
independent contractors, and their services are subject to the terms
and conditions specified by them. Robert Petker will not be liable for
any accident, loss, injury, or damage occurring to any participant in
connection with any accommodations, transportation or other services or
resulting directly or indirectly from any occurrence or conditions
beyond his control, including defects in vehicles, breakdown of
equipment, strikes, sickness, weather, war, acts of terrorists,
quarantine, theft, delay or cancellation of or changes in itinerary or
schedules, other causes or acts of God. All travel documents, as well
as compliance with customs regulations are the tour participant's
responsibility. Airlines concerned are not to be held responsible for
any act, omission or event during the time the tour participant is not
on board the aircraft. The passage contract in use by the airline, when
issued, constitutes the sole agreement between it and the tour
participant.
Deposits and Payments
All deposits received from clients are deposited in the Petker Tours
Inc. Trust Account, number 20907C16, a federally insured account, at
Merrill Lynch, Bakersfield CA. Money in this account is used only for
tour operations.
Insurance
If you elect not to take insurance, you will be responsible for
your own medical care, evacuation in case of emergency plus any
cancellation penalties.
Prices
All prices are subject to change because of fluctuation of exchange
rates or price changes and/or surcharges by suppliers.
Refunds
All payments for transportation or travel service not provided to the
passenger shall be promptly refunded, in accordance with the agreed-to
terms and conditions, unless the passenger otherwise instructs the
seller of travel in writing. This provision does not apply
where the seller of travel has remitted the payment to another
registered wholesale seller of travel or a carrier, without obtaining a
refund, and where the wholesaler or provider defaults in providing the
agreed-upon transportation or service. In this situation, Petker Tours
Inc. must provide the passenger with a written statement and records
establishing the disbursement of the payment and proof of registration
of that wholesaler.
The California Travel Consumer
Restitution Fund
This business is a participant in the Travel Consumer restitution
Corporation (TCRC).
If you, the passenger, are located in California at the time of payment, you may request reimbursement from TCRC if you are owed a refund of more than $50 for transportation or travel services which was not refunded in a timely manner by a seller of travel who was registered and participating in the TCRC at the time of sale. The maximum amount which may be paid by the TCRC to any on passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000.
A claim must be submitted to the TCRC within six months after the scheduled completion date of the travel. A claim must include sufficient information and documentation to prove your claim and a $35 processing fee. You must agree to waive your right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a claim with the TCRC, if you were located in California at the time of the sale.
